Terms & Conditions
Please read these terms carefully before accessing or using Video Doctor. These terms govern your use of our website, telemedicine video consultations, doctor counselling services, and payment workflows.
Video Doctor is a remote telemedicine communication facilitator and is NOT an emergency medical response service. If you are experiencing a life-threatening medical emergency (such as severe chest pain, shortness of breath, sudden numbness, uncontrolled bleeding, or suicidal thoughts), please immediately call your local emergency hotline (112, 911, or 999) or proceed to the nearest hospital emergency room.
01. Acceptance of Terms & Platform Scope
These Terms and Conditions (“Terms” or “Agreement”) constitute a legally binding agreement between you (“User”, “Patient”, or “Doctor”) and Video Doctor (“we”, “our”, or “us”). By accessing our website, booking an appointment, participating in a video consultation, or issuing a digital prescription, you signify that you have read, understood, and agree to be bound by these Terms.
Video Doctor operates as an encrypted, browser-based telemedicine technology platform facilitating virtual video consultations, appointment management, digital prescriptions, diagnostic lab investigations, and payment processing between registered healthcare practitioners and patients.
02. User Eligibility & Account Registration
To use Video Doctor, you must satisfy the following minimum requirements:
- Patients: You must be at least 18 years of age. Minor patients may receive consultations only when scheduled and accompanied by a parent or legal guardian who provides informed consent.
- Healthcare Practitioners (Doctors): You must be an authorized medical professional holding a current, valid, and unrestricted license issued by the relevant State or National Medical Council. Doctors must complete mandatory verification (KYC) before providing consultations.
- Account Accuracy: You agree to provide truthful, accurate, and current medical and personal contact details during onboarding, authentication, and consultation intake.
03. Medical Disclaimer & Emergency Notice
Video Doctor provides the software infrastructure enabling telehealth sessions but does not practice medicine directly. The telemedicine encounter cannot fully replicate in-person physical examinations requiring palpation, auscultation, emergency surgery, or immediate diagnostic imaging.
⚠️ Limitations of Telemedicine:
The consulting practitioner may, in their sole medical discretion, determine that a patient's symptoms or condition require an in-person physical clinical visit, specialized diagnostic testing, or emergency department transfer.
04. Doctor Independence & Professional Conduct
All medical practitioners on Video Doctor act as independent professionals. Video Doctor does not interfere with, dictate, or influence any clinical evaluations, therapeutic interventions, diagnosis, or prescription decisions made by treating doctors.
Doctors are solely responsible for ensuring that all medical advice, diagnostic recommendations, and prescriptions strictly comply with statutory telemedicine practice guidelines and healthcare ethical standards in their respective jurisdiction.
05. Telehealth Video Consultations & WebRTC
Video Doctor provides browser-based real-time video consultations utilizing secure WebRTC standards. To participate, users must ensure:
- Access to a compatible modern web browser (Google Chrome, Mozilla Firefox, Apple Safari, or Microsoft Edge).
- A working camera, microphone, and stable internet connection (minimum 1 Mbps recommended).
- Participation from a private, well-lit, and quiet setting to maintain healthcare confidentiality.
Neither party may record audio or video streams during a consultation session without explicit, mutual written consent of both the practitioner and the patient.
06. Consultation Fees & Payment Processing
Consultation fees are established transparently by healthcare practitioners and displayed in US Dollars ($) prior to appointment confirmation:
- Payment Gateway: All financial transactions are processed securely via PCI-DSS certified payment processors (Stripe). We do not store raw credit/debit card numbers on Video Doctor servers.
- Billing Integrity: Patients will be billed only the displayed consultation fee. No unauthorized recurring charges or hidden fees apply to one-time consultation bookings.
- Invoicing: A formal digital payment receipt and consultation invoice in USD ($) is made available immediately upon successful transaction completion.
07. Cancellations, Rescheduling & Refunds
Patient Cancellations: Appointments cancelled at least 2 hours prior to the scheduled start time are eligible for a 100% refund back to the original payment method.
Doctor Unavailability: If a consulting practitioner fails to attend a scheduled session or is forced to cancel due to unforeseen clinical emergencies, the patient will be offered an immediate complimentary reschedule or an automatic full refund.
Refund Processing Time: Approved refunds are submitted to Stripe immediately and typically reflect in the user's bank statement within 5 to 7 business days, subject to the cardholder's financial institution.
08. Doctor Payouts & Platform Commission
For facilitating technological infrastructure, WebRTC media routing, SMS notifications, and transaction processing, Video Doctor applies an agreed platform commission on consultation fees.
Doctors receive their net settlement disbursements (consultation fee less the configured platform commission) via automated Stripe Connect transfers or verified direct bank transfers according to established settlement schedules.
09. Digital Prescriptions & Lab Orders
When medically warranted, consulting practitioners may issue digital prescriptions or diagnostic laboratory recommendations through the platform:
- Digital prescriptions contain the doctor's verified credentials, registration number, patient identifier, diagnosis, and medication instructions.
- Patients receive direct access to tamper-evident prescription PDFs via secure SMS and web portal links.
- Controlled substances, narcotics, and certain scheduled psychotropic drugs cannot and will not be prescribed via telemedicine under applicable statutory regulations.
10. User Conduct & Session Privacy
Users agree not to engage in any of the following prohibited behaviors:
- Harassing, threatening, or behaving inappropriately towards practitioners or patients.
- Impersonating any other individual or falsifying medical histories.
- Attempting to record, capture, or redistribute consultation video streams without authorization.
- Introducing malware, reverse engineering the platform, or disrupting WebRTC servers.
11. Limitation of Liability & Disclaimers
To the fullest extent permitted by law, Video Doctor and its affiliates, directors, employees, and technology providers shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from technical connection dropouts, internet failures, or professional medical negligence of independent practitioners.
Our total cumulative liability under this Agreement shall not exceed the amount paid by you for the specific consultation session giving rise to the claim.
12. Governing Law, Dispute Resolution & Contact
These Terms shall be interpreted, governed, and construed in accordance with the laws of India, without giving effect to any conflict of law principles. Any dispute or claim arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts.
